Welcome to AgileBuilder. AgileBuilder is a product provided by Taiyuan Yijin Technology Co., Ltd. These Terms of Service ("Terms") apply to your access to or use of AgileBuilder websites, desktop applications, local versions, cloud features, template services, support channels, and related functionality (collectively, the "Services").
By accessing, downloading, installing, registering for, purchasing, or using the Services, you agree to be bound by these Terms.
1. Service Provider
The Services are provided by Taiyuan Yijin Technology Co., Ltd. ("we", "us", or "our").
"AgileBuilder" is our brand name for products and services related to development efficiency.
2. Scope and Acceptance
- You must have the legal capacity and authority required to accept these Terms.
- If you use the Services on behalf of a company, team, or other organization, you represent that you are authorized to bind that organization.
- If you do not agree to these Terms, do not access or use the Services.
- We may publish supplemental terms for specific features, plans, programs, or services. Those supplemental terms form part of these Terms.
3. Description of the Services
AgileBuilder is designed to help developers and teams:
- create, manage, and reuse project templates
- generate standardized project scaffolds and engineering structures
- connect to AI tools, automation flows, or extensions through MCP or similar mechanisms
- manage related project configuration, assets, and collaboration data in local or cloud environments
We may update, improve, restrict, or discontinue features from time to time for product, security, compliance, operational, or technical reasons.
4. Accounts and Access
4.1 Registration Information
To use certain features, you may need to create an account. You agree to:
- provide true, accurate, complete, and current information
- keep your credentials confidential and secure
- promptly update outdated or inaccurate information
4.2 Account Responsibility
- You are responsible for all activity under your account.
- You must notify us promptly if you become aware of unauthorized access, credential compromise, abuse, or another security incident.
- You may not sell, transfer, rent, share, or sublicense your account without our prior written permission.
5. Acceptable Use
You may not use the Services to:
- violate applicable laws, regulations, or public policy
- infringe intellectual property rights, privacy rights, publicity rights, trade secrets, or other lawful rights of others
- reverse engineer, bypass access controls, probe vulnerabilities, interfere with system stability, or obtain unauthorized access
- upload or distribute malicious code, malware, spyware, viruses, scraping tools, or abusive automation
- create, distribute, or facilitate illegal, fraudulent, infringing, harassing, violent, gambling, pornographic, or otherwise improper content
- exceed authorized usage limits, evade billing, abuse APIs, or materially degrade the experience of other users
If we reasonably believe you have violated this section, we may restrict functionality, suspend access, terminate the account, deny refunds, or take other appropriate action.
6. User Content and Data
6.1 Ownership of Your Content
Except as otherwise required by law or agreed in writing, you retain ownership of the templates, documents, project settings, code snippets, text, and other content that you upload, create, store, generate, or manage through the Services.
6.2 License You Grant to Us
To provide the Services, you grant us a non-exclusive, revocable, and limited license to host, store, transmit, back up, display, process, and technically adapt your content as necessary to operate, maintain, secure, and improve the Services.
This license does not transfer ownership of your content to us.
6.3 Your Responsibility
You are responsible for ensuring that the content and data you submit or process through the Services are lawful and that you have all necessary rights and permissions to use them. You are solely responsible for claims, disputes, or liabilities arising from your content.
7. Intellectual Property
- The AgileBuilder websites, apps, interfaces, trademarks, logos, documentation, sample materials, software code, and related technology are owned by us or our licensors.
- Any open source version is governed by its applicable open source license.
- Unless we expressly allow it in writing, you may not copy, resell, sublicense, or use our commercial offerings, protected materials, or branding for competing purposes.
8. Subscriptions, Payments, and Refunds
8.1 Billing
- Paid plans, billing cycles, feature scope, and seat rules are governed by the pricing page, order details, or any separate written agreement applicable to your purchase.
- Unless expressly stated otherwise, paid subscriptions are prepaid.
- You must provide valid payment information and complete payment in a timely manner.
8.2 Refund Policy
The following refund policy applies to standard online subscription orders:
14-Day Unconditional Refund
- You may request a full refund within 14 calendar days from the successful payment date of the applicable order.
- During that 14-day period, a reason is generally not required, and approved refunds will be returned to the original payment method.
No Refunds After 14 Days
- Once more than 14 calendar days have passed from the successful payment date of the applicable order, that order is not eligible for a refund.
- We do not provide pro-rata refunds, partial refunds, or refunds based on unused time after the 14-day period.
How to Request a Refund
- Submit your refund request through the refund entry on the workspace subscription page
- Please review the relevant order, account, and subscription details in that workflow so the system can validate and process the request
Processing
- We typically review complete refund requests within 1-3 business days
- After approval, the actual arrival time of funds depends on the payment provider, bank, or card network
8.3 Pricing Changes
We may change pricing for future purchases or renewals. Pricing changes will not retroactively alter the amount already paid for your current order unless required by law or separately agreed.
9. Changes, Suspension, and Termination
- We may update, suspend, limit, or discontinue all or part of the Services for maintenance, upgrades, security, compliance, operational, force majeure, or other legitimate reasons.
- We may suspend or terminate your access if you violate these Terms, violate applicable law, or create risk for us, other users, or third parties.
- You may stop using the Services at any time. If you need account closure or deletion support, you may contact us or use any in-product workflow that we provide.
10. Third-Party Services
The Services may integrate with third-party payment providers, identity services, analytics tools, cloud infrastructure, model providers, or external links.
Those third-party services are independently provided and may be governed by their own terms and policies. We are not responsible for guaranteeing their continued availability or performance.
11. Disclaimer of Warranties
- The Services are provided on an "as is" and "as available" basis.
- To the fullest extent permitted by law, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, uninterrupted operation, compatibility, and accuracy of results.
- You understand that software tools, AI integrations, template generation, and automation features may produce errors, interruptions, deviations, or unexpected outcomes due to model behavior, runtime environments, network conditions, third-party dependencies, or configuration differences. You are responsible for independent review and backups.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, loss of profits, loss of goodwill, loss of data, or business interruption
- our aggregate liability arising out of or relating to the Services will not exceed the amount you actually paid to us for the specific paid Services giving rise to the claim during the 12 months preceding the event
If applicable law does not allow certain exclusions or limitations, the above limitations apply only to the maximum extent permitted.
13. Updates to These Terms
We may revise these Terms from time to time for product, operational, or compliance reasons. Updated Terms become effective when posted, or on any later effective date stated in the updated Terms.
Your continued use of the Services after the updated Terms take effect constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People's Republic of China.
Any dispute arising out of or relating to these Terms or the Services that cannot be resolved through friendly consultation may be submitted to the competent People's Court with jurisdiction over the location of Taiyuan Yijin Technology Co., Ltd.
